Welcome to Golf Access (“Site”). These Terms & Conditions (“Terms”) govern your access to and use of our directory services, listings, and all content (collectively, “Services”). Please read them carefully. By accessing or using the Services, you agree to be bound by these Terms.

1. Definitions

• “We,” “us,” “our” means GolfAccess.com, branded as “Golf Access”.
• “You,” “User,” “Member” means any person or entity accessing or using the Services.
• “Directory” means the online platform through which golf-related businesses are listed.
• “Golf Business” means any entity offering golf courses, instruction, equipment, events, training centers, retail, or related services.
• “Content” means text, images, reviews, ratings, logos, and other materials provided on the Site.
• “Verified Listing” means a listing for a Golf Business that has been officially claimed and verified by us through a defined process.

2. Acceptance of Terms

By accessing or registering on the Site, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have legal capacity to enter into this agreement. If you do not agree, you must immediately cease use.

3. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes take effect when posted on the Site or via notice (email or banner). Continued use of the Services after changes constitutes acceptance.

4. User Accounts & Registration

• Account Creation: You must provide accurate, complete information.
• Security: You are responsible for safeguarding your password and account.
• Termination: We may suspend or terminate your account for any breach of these Terms or misuse of the Services.

5. Use of the Directory & Services

• Permitted Uses: Searching, viewing, contacting, rating, and reviewing Golf Businesses for personal or professional use.
• Prohibited Uses:
  • Automated data scraping or harvesting
  • Unauthorized resale or distribution of Content
  • Posting unlawful, harassing, or obscene materials
• Access Restrictions: We may limit or block access to any feature for any reason.

6. User-Generated Content

• Types of Content: Reviews, ratings, photos, comments, testimonials.
• License Grant: By submitting Content, you grant us a perpetual, worldwide, royalty-free, transferable license to use, modify, reproduce, and display it.
• Standards & Moderation: Content must be lawful, truthful, non-infringing, and respectful. We may remove or refuse any Content at our discretion.
• Copyright Policy: DMCA notices should be sent via our Contact Page.

7. Business Listings & Advertising

• Eligibility: Any Golf Business may apply to be listed, subject to our approval.
• Fees & Payments:
  • Listing Fee: Fees for listings are determined at the time of application or renewal.
  • Renewal: Listings may be subject to periodic renewal terms as specified during the listing process.
• Accuracy & Disclaimers: Businesses are responsible for the accuracy of their listing. We do not endorse or guarantee any Business.

7.1 Claiming a Verified Listing

• Eligibility for Verification: Only authorized representatives of a Golf Business may claim a Verified Listing. You must provide proof of ownership or authorization (e.g., business registration documents, official email address, or other verification methods as requested).
• Verification Process: We reserve the right to approve or deny verification requests at our sole discretion. The process may require submission of additional information or documentation to confirm the legitimacy of the business and the claimant’s authority.
• Responsibilities of Verified Businesses:
  • Maintain accurate, up-to-date information in the listing, including contact details, services offered, and operating hours.
  • Respond promptly to user inquiries or reviews through the platform, adhering to professional conduct standards.
  • Comply with all applicable local, national, and international laws related to your business operations and advertising.
• Updates to Listing Details: Verified Businesses are permitted to update their listing details as needed to reflect accurate and current information. However, all updates are subject to review and approval by us to ensure compliance with our content standards and policies.
• No Liability for Business Content: We are not responsible or liable for the accuracy, completeness, legality, or appropriateness of any content, information, or materials provided by Verified Businesses in their listings. Businesses bear full responsibility for the content they submit or update, and we disclaim any liability for damages or disputes arising from such content.
• Right to Modify Content: We reserve the right to modify, edit, or remove any content in a Verified Listing at our sole discretion, without prior notice, to ensure compliance with these Terms, maintain the integrity of the Directory, or address user concerns. This includes, but is not limited to, correcting errors, removing inappropriate material, or updating outdated information.
• Fees for Verification: If applicable, fees for claiming or maintaining a Verified Listing will be communicated during the verification process. Such fees are non-refundable unless otherwise specified.
• Use of Verified Status: Businesses with Verified Listings must not misuse the “Verified” badge or imply endorsement by Golf Access beyond the scope of verification. Misrepresentation may result in revocation of verified status.
• Revocation or Suspension: We may revoke or suspend a Verified Listing at any time for reasons including, but not limited to, failure to comply with these Terms, submission of false information, user complaints, or suspected fraudulent activity. Businesses will be notified of such actions and may appeal via our Contact Page.
• Limitation of Liability: Verification does not constitute an endorsement, guarantee, or warranty of the quality, reliability, or legality of the Golf Business. We are not liable for any disputes, damages, or issues arising from interactions with Verified Listings.

8. Intellectual Property

All Site content, trademarks, and logos are owned by us or our licensors. You may view and print Content for personal, non-commercial use only. Any other copying, distribution, or creation of derivative works is prohibited.

9. Privacy & Data Protection

Your privacy is governed by our Privacy Policy. By using the Site, you consent to our collection and use of data as described there.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICES ARE ACCURATE, COMPLETE, OR UNINTERRUPTED.

You agree to indemnify, defend, and hold harmless GolfAccess.com, its affiliates, officers, and employees from any claim, liability, loss, or expense (including attorneys’ fees) arising from your breach of these Terms or your use of the Services.

13. Termination

We may terminate or suspend your access, in whole or in part, with or without notice, for any conduct that we, in our sole discretion, believe violates these Terms or is harmful to other users.

The Site may contain links to third-party websites. We have no control over, and assume no responsibility for, their content or practices. Use them at your own risk.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts in Singapore.

16. Dispute Resolution

• Informal Negotiation: Parties will attempt to resolve disputes amicably.

17. Severability & Waiver

If any provision is found invalid or unenforceable, the remainder remains in full force. No waiver is effective unless in writing and signed by us.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement and supersede all prior understandings.
